Terms of Service

By accessing or using any Exoliner services, websites, APIs, or software (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you (“User”, “you”) and Exoliner (“we”, “us”, “our”), operated by Cornelia Reise.

By creating an account or using the Service, you represent that you are at least 16 years of age. If you are under 18, you confirm that you have parental or guardian consent.

For the purposes of these Terms, “Operational Lifetime” means the period during which Exoliner actively provides the Service, ending upon permanent discontinuation announced with at least thirty (30) days' prior notice to Users via the Service, email, or our Discord server. The Operational Lifetime does not refer to the lifetime of any individual User.

When you create an account with Exoliner, you agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your account credentials
• Not share, transfer, or sell your account to any third party
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent or abusive behavior.

You agree not to engage in any of the following prohibited activities:

• Reverse Engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code, underlying algorithms, or architecture of any Exoliner software, API, or service
• Unauthorized Access: Attempting to gain unauthorized access to any part of the Service, other users' accounts, or our servers and infrastructure
• Circumvention: Bypassing, disabling, or interfering with any security features, access controls, authentication mechanisms (including Turnstile CAPTCHA verification and IP-based verification), or usage limitations of the Service
• Redistribution: Copying, redistributing, reselling, sublicensing, or making available any part of the Service to third parties without our express written consent
• Abuse & Exploitation: Using the Service to harass, threaten, or harm other users, or to engage in any illegal, fraudulent, or malicious activity
• Automated Access: Using bots, scrapers, crawlers, or other automated means to access or interact with the Service without our express permission. The Service employs Cloudflare Turnstile CAPTCHA and IP verification to detect and prevent automated or unauthorized access.
• Impersonation: Impersonating Exoliner staff, other users, or any third party while using the Service
• Service Disruption: Intentionally interfering with, disrupting, or degrading the performance or availability of the Service for others
• Sanctions & Export Violations: Using the Service in violation of applicable export control laws, trade sanctions, or embargoes

Violation of these prohibitions may result in immediate account termination without notice or refund.

All content, software, code, design, graphics, trademarks, logos, and other materials associated with the Service (“Exoliner IP”) are the exclusive property of Exoliner or its licensors and are protected by applicable intellectual property laws.

Your use of the Service grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for personal, non-commercial purposes, subject to these Terms. This license does not grant you any ownership rights over Exoliner IP.

You may not reproduce, modify, distribute, create derivative works from, publicly display, or commercially exploit any Exoliner IP without our prior written authorization.

You are solely responsible for any content you submit, upload, or transmit through the Service, including but not limited to chat messages, scripts, and profile information (“User Content”).

You agree that your User Content will not:

• Contain illegal, harmful, threatening, abusive, or discriminatory material
• Infringe upon the intellectual property or privacy rights of any third party
• Contain malware, viruses, or any code designed to harm the Service or its users
• Include personal information of other individuals without their consent

We reserve the right to review, moderate, and remove any User Content at our sole discretion and without prior notice.

We may monitor usage of the Service to detect abuse, security threats, or violations of these Terms. This monitoring is carried out in accordance with our Privacy Policy.

We may take technical or administrative measures to prevent abuse or protect the integrity of the Service, including but not limited to IP blocking, Turnstile CAPTCHA verification, IP-based access verification, and account restrictions.

Certain features of the Service require a paid plan. Exoliner plans are sold as one-time lifetime purchases, granting access for the Operational Lifetime of the Service (as defined in Section 1). By purchasing a plan, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide valid payment information through one of our authorized payment processors
• Accept that plan fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy
• Understand that “lifetime” refers to the Operational Lifetime of the Exoliner Service, not the lifetime of the purchaser

We reserve the right to modify pricing at any time. Price changes will not affect plans that have already been purchased.

Exoliner may offer a referral program that allows Users to earn commissions by referring new customers to the Service. Participation in the referral program is subject to the following terms:

• Referral commissions are calculated as a percentage split of the referred purchase price, as displayed in your referral dashboard at the time of referral
• Commission rates may be modified by Exoliner at any time with prospective effect
• Payouts of earned commissions are processed according to the payout schedule and minimum thresholds displayed in the referral dashboard
• Self-referrals, fraudulent referrals, or referrals obtained through spam, misleading advertising, or any form of deception are strictly prohibited and will result in forfeiture of all pending commissions and potential account termination
• Exoliner reserves the right to withhold, reverse, or reclaim commissions in cases of fraud, chargebacks, refunds, or violations of these Terms
• Exoliner may suspend or discontinue the referral program at any time with reasonable notice

The referral program does not create an employment, partnership, or agency relationship between you and Exoliner. Referral participants are solely responsible for any applicable tax obligations arising from referral commissions.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law:

• We do not guarantee uninterrupted, error-free, or secure operation of the Service
• We are not liable for any data loss, service interruption, or damages arising from your use of the Service
• Our total liability to you for any claims arising from the Service shall not exceed the total amount you have paid to Exoliner in the twelve (12) months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the greatest extent permitted by law.

We may suspend or terminate your access to the Service for legitimate reasons, including but not limited to:

• Violation of these Terms or any applicable policies
• Engaging in prohibited conduct as outlined in Section 3
• Failure to pay applicable fees
• Requests from law enforcement or other government agencies
• Extended periods of inactivity

You may terminate your account at any time by contacting us at [email protected] or through our Discord support channel.

Upon termination, your right to use the Service ceases immediately. Termination for violation of these Terms may result in loss of access to your paid plan without refund. We may retain certain data as required for legal, security, or operational purposes, in accordance with our Privacy Policy.

The Service may interact with or be used in connection with third-party platforms, including but not limited to Roblox and other gaming platforms. You acknowledge and agree that:

• You are solely responsible for ensuring your use of the Service complies with all applicable terms of service, community guidelines, and rules of any third-party platform
• Exoliner does not guarantee compatibility with, authorization from, or endorsement by any third-party platform
• Exoliner is not affiliated with, endorsed by, or sponsored by Roblox Corporation or any other third-party platform provider
• Any consequences arising from your use of the Service on third-party platforms (including account suspensions, bans, or other penalties imposed by those platforms) are your sole responsibility
• Exoliner shall not be liable for any changes, restrictions, or actions taken by third-party platforms that affect the functionality or availability of the Service

Use of the Service does not confer any rights or permissions with respect to any third-party platform. It is your obligation to understand and comply with all third-party terms before using the Service in connection with those platforms.

The Service may include AI-powered assistant features (the “AI Assistant”), currently powered by Mistral AI (Devstral 2) or other third-party AI providers. Each user receives $2.00 USD of free AI credits per month, which reset automatically every 30 days. By using the AI Assistant, you acknowledge and agree that:

• The AI Assistant is provided on an “as is” basis without any warranties of accuracy, completeness, reliability, or fitness for any particular purpose
• AI-generated responses may contain inaccurate, incomplete, misleading, or outdated information
• You are solely responsible for reviewing, verifying, and evaluating any output produced by the AI Assistant before relying on or acting upon it
• Exoliner does not guarantee that the AI Assistant will be available at all times and may modify, suspend, or discontinue it at any time without prior notice
• You shall not use the AI Assistant to generate content that violates these Terms, applicable laws, or the rights of any third party
• Inputs submitted to the AI Assistant may be processed by third-party AI providers subject to their own terms of service and privacy policies

Exoliner expressly disclaims all liability for any actions taken or decisions made based on AI Assistant output. The AI Assistant is not a substitute for professional advice of any kind.

The Service includes a real-time chat system that enables communication between Users. By using the chat system, you acknowledge and agree that:

• All chat messages are permanently stored on our servers for moderation, safety, and operational purposes
• Exoliner reserves the right to monitor, review, and moderate all chat messages at any time without prior notice
• You shall not use the chat system to transmit spam, advertisements, solicitations, malware, or any content that violates these Terms or applicable laws
• You shall not use the chat system to harass, threaten, impersonate, or intimidate other Users
• Exoliner may remove chat messages, mute Users, or restrict chat access at its sole discretion for any reason, including but not limited to violations of these Terms

Message content is retained indefinitely unless deletion is required by applicable law. You acknowledge that messages sent through the chat system should not be considered private and may be reviewed by Exoliner staff for moderation purposes.

Exoliner may offer an optional desktop client application (the “Desktop App”) as a supplementary means of accessing the Service. By downloading and using the Desktop App, you acknowledge and agree that:

• The Desktop App is provided on an “as is” basis and may contain bugs, errors, or security vulnerabilities
• The Desktop App may automatically download and install updates without prior notice to ensure security, compatibility, and feature parity with the Service
• Exoliner may make VirusTotal scan results available for the Desktop App as a transparency measure; however, this does not constitute a guarantee of safety, and you install and run the Desktop App at your own risk
• You are responsible for ensuring that the Desktop App is compatible with your operating system and hardware
• Exoliner is not liable for any damage to your computer, data loss, or security incidents arising from the installation or use of the Desktop App
• The Desktop App is subject to all other provisions of these Terms, including the license restrictions in Section 4

The Service may support authentication and integration through third-party OAuth providers and may expose application programming interfaces (“APIs”) for authorized use. By using OAuth or API features, you acknowledge and agree that:

• When authenticating via third-party OAuth providers, you grant Exoliner access only to the information and permissions explicitly requested during the authorization flow
• You are responsible for reviewing and understanding the permissions requested by any OAuth authorization before granting consent
• API access, if provided, is subject to usage limits, authentication requirements, and any additional API-specific terms published by Exoliner
• You shall not abuse, overload, or use API access in a manner that degrades the Service for other Users
• Exoliner may revoke OAuth tokens or API access at any time for any reason, including suspected abuse or violation of these Terms
• Third-party OAuth providers are governed by their own terms of service and privacy policies, for which Exoliner bears no responsibility

You agree to indemnify, defend, and hold harmless Exoliner and its operator, Cornelia Reise, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any applicable laws or third-party rights
• Any User Content you submit or transmit through the Service
• Any scripts you create, upload, share, or execute through the Service and their effects on any third-party platform or its users
• Your violation of any third-party platform's terms of service or community guidelines while using the Service

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and may notify users through the Service or via e-mail.

Your continued use of the Service after any modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and close your account.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

For consumers residing in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

Exoliner shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Exoliner's reasonable control (“Force Majeure Event”), including but not limited to:

• Natural disasters, epidemics, or pandemics
• Acts of war, terrorism, civil unrest, or government actions
• Failures or disruptions of internet infrastructure, hosting providers, or third-party services
• Cyberattacks, distributed denial-of-service attacks, or other security incidents beyond our reasonable control
• Power outages, hardware failures, or telecommunications disruptions
• Changes in applicable laws, regulations, or government orders

In the event of a Force Majeure Event, Exoliner's obligations under these Terms shall be suspended for the duration of the event. We will use reasonable efforts to notify Users of any material disruption and to resume the Service as soon as practicable.

The following sections of these Terms shall survive any termination or expiration of these Terms or your use of the Service:

• This Section 19 (Survival)

Any provision of these Terms that by its nature is intended to survive termination (including, without limitation, obligations relating to intellectual property, limitation of liability, indemnification, and governing law) shall continue in full force and effect after termination.
